1. Acceptance of Terms

By downloading, installing, or using Tome ("the Software"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Software.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Software on devices you own or control, solely for your personal, non-commercial use.

3. Restrictions

You agree not to:

  • Copy, modify, or distribute the Software
  • Reverse engineer, decompile, or disassemble the Software
  • Rent, lease, or lend the Software to third parties
  • Remove any proprietary notices or labels on the Software
  • Use the Software for any unlawful purpose

4. Intellectual Property

The Software and all copies thereof are proprietary to us and title remains with us. All rights in the Software not specifically granted in these Terms are reserved to us.

5. Your Data

Tome is a local-first application. Your notes and data are stored on your device. We do not have access to, collect, or store any of your content. You are solely responsible for maintaining backups of your data.

6. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE.

7. Limitation of Liability

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SOFTWARE.

8. Updates

We may release updates, upgrades, or new versions of the Software. These Terms apply to all such updates unless we provide separate terms with the update.

9. Termination

These Terms are effective until terminated. Your rights under these Terms will terminate automatically if you fail to comply with any of its provisions. Upon termination, you must cease all use of the Software and destroy all copies.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the "Last updated" date. Your continued use of the Software after such changes constitutes acceptance of the new Terms.
