End-User License Agreement

This End-User License Agreement ("EULA") is a legal agreement between you ("User") and the developers of Tome ("Licensor") for the use of Tome software application ("Software").

1. Grant of License

Subject to the terms of this EULA, Licensor grants you a limited, non-exclusive, non-transferable license to:

• Download, install, and use the Software on devices owned or controlled by you
• Use the Software for personal or commercial productivity purposes
• Make a reasonable number of backup copies for archival purposes

2. License Types

Personal License

A Personal License permits the use of the Software by a single individual on up to three (3) devices owned by that individual.

Team License

A Team License permits the use of the Software by the number of users specified in your purchase, with each user allowed up to three (3) devices.

3. Restrictions

You may not:

• Distribute, sublicense, lease, rent, or lend the Software to third parties
• Modify, translate, adapt, or create derivative works based on the Software
• Reverse engineer, disassemble, decompile, or attempt to derive the source code
• Remove, alter, or obscure any proprietary notices on the Software
• Use the Software to develop a competing product
• Share license keys or credentials with unauthorized users

4. Ownership

The Software is licensed, not sold. Licensor retains all right, title, and interest in and to the Software, including all intellectual property rights. This EULA does not grant you any rights to trademarks or service marks of Licensor.

5. Your Content

You retain all rights to the content you create using the Software. The Software stores your content locally on your device. Licensor does not have access to, and makes no claim to, any content you create.

6. Updates and Support

Licensor may provide updates, patches, or new versions of the Software at its discretion. Your license includes access to updates for one (1) year from the date of purchase. After this period, you may continue to use your current version or purchase a renewal for continued updates.

7. Refund Policy

We offer a 30-day money-back guarantee. If you are not satisfied with the Software for any reason, contact us within 30 days of purchase for a full refund.

8. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. LICENSOR DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SOFTWARE, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

LICENSOR'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SOFTWARE.

10. Termination

This license is effective until terminated. It will terminate automatically if you fail to comply with any term of this EULA. Upon termination, you must destroy all copies of the Software. Sections 4, 8, 9, and 11 shall survive termination.

11. Governing Law

This EULA shall be governed by and construed in accordance with the laws of the jurisdiction in which Licensor is established, without regard to its conflict of law provisions.

12. Entire Agreement

This EULA constitutes the entire agreement between you and Licensor regarding the Software and supersedes all prior agreements and understandings, whether written or oral.
